Arbitrary Marks
Definition:
Comprise words that are in common linguistic use but, when used to identify particular goods or services, do not suggest or describe a significant ingredient, quality or characteristic of the goods or services.
Work Made for Hire
Definition:
A work prepared by an employee within the scope of his or her employment or a commissioned work that the parties agree in writing to treat as a work made for hire.
Good Will
Definition:
The value of a business or of a line of goods or services that reflects commercial reputation. A business with a well-established good will could see all of its tangible assets destroyed, yet still own its reputation, its good will.
